PROCEDURE

 

Upon receiving an application for a hearing, the JAG Office assembles its team of Officers as outlined above. Once assembled, JAG informs the JAG District of the need to commence a trial.

 

At this time, the Federation Command District Attorney gathers evidence and seeks witnesses.
 

It is the Federation Command District Attorney's job to ensure a gulity charge is achieved and he will perform his duty to the best of his ability.

 

All evidence gathered is passed over to the Defending Attorney. The Defending Attorney then has 4 days to speak to his client and to prepare their defense.

JAG will set forth a date for a hearing. This must be no lees than 4 days and no more than 7 days from the initial allegation set by the Admiral Council and or a commanding officer.

HEARING

 

The hearing will be held on a suitable gaming room or by MSN/ICQ . Present for the hearing will be the JAG core, the Defendant and his Attorney.

 

No other aprties are allowed in the hearing chambers. Witnesses will then be called forth by both parties, starting with the District Attorney. Witnesses are asked not to speak to outside people before or after the hearing. These matters are to remain classified and failing to do so carries penalties.

 

The hearing begins with JAG reading the list of charges to which the defendant may respond - "Not Guilty". As this is a hearing to confirm the charges; there is no need for a right to plead "Guilty".

 

At this time, the District Attorney begins his case for Federation Command. Evidence will be submitted and witnesses called. The Defence Attorney has the right to cross examine all witnesses. Once the District Attorney has finished his case, the Defence is then free to call their witnesses and/or enter evidence of their own.

 

The District Attorney will then have the right to cross examine the Defense's witness's.

 

Each party, starting with the District Atorney will then be given a chance to provide a closing statement.

Upon completion, the JAG core will convene to discuss the evidence. Only the JAG core may be in attendance at this time. Once a verdict has been reached, the JAG core will invite all parties involved back into the chambers to render their decision.

 

 

THE DECISION HANDED DOWN BY THE JAG CORE IN FINAL

 

The Deceision made by the JAG and his group of officier is final.you cannot appeal of it until u have proof.
